Arizona father allegedly kills infant son days after being granted temporary custody

An Arizona father stands accused of killing his 10-month-old son just after getting temporary custody of the baby.

Jimmy Torre McElroy, 28, was charged with second-degree murder and child abuse in connection to the death of his infant son.

On Oct. 21, police responded to McElroy’s home over reports of a baby suffering from seizures.

The baby was rushed to Tucson Medical Center where he was diagnosed with severe injuries including a displacement in his brain, a skull fracture, and hemorrhaging in both eyes.

Doctors said the baby’s injuries were fatal. He died earlier this week.

  • The father told detectives the baby fell off the bed and suffered seizures before admitting to dropping the child on his head.

    McElroy explained that when the baby suffered a seizure after the fall, he “gently shook the baby to make him snap out of it.”

    However, doctors said the “gentle” shaking wouldn’t have caused the child hemorrhaging in the eyes.

    McElroy reportedly called his mother, a friend, his girlfriend, and a doctor before calling the police, according to phone records.

    His charges were upgraded from child abuse to second-degree murder following his son’s death.
