Father arrested after firing shots at driver who had just struck, killed toddler

A California father is behind bars facing criminal charges days after losing his 2-year-old son in a tragic crash.

Stanislaus County authorities said Elvis Zepeda and his 2-year-old son were standing near a food truck on the west shoulder of SR-33 Tuesday when the child ran into an oncoming northbound BMW.

  • The father chased after the toddler who was fatally hit by the car. The driver stopped after hitting the child, but Zepeda retrieved a gun and started shooting at him, striking the rear of the vehicle.

    The toddler, identified on a GoFundMe page as Benjamin Zepeda, died at Doctors Medical Center.

    His father was arrested and booked into the Stanislaus County Public Safety Center on counts of attempted murder, possession of an illegal firearm, and possession of a controlled substance.
