Nebraska bar owner won't be charged with murder of 22-year-old protester

Prosecutors have no plans to charge a bar owner who fatally shot a George Floyd protester on Saturday claiming that the shooting was in self-defense.

Jake Gardener was caught in video surveillance standing outside his Hive Bar in Omaha and urging protesters to leave before confronting a group of them that included the victim, James Scurlock.

According to Douglas County Attorney Don Kleine the young man jumped on the bar owner's back and was trying to choke him when the latter warned him by shooting twice to the air.

"Mr. Gardner, as we know now, has said I did what I did to defend myself and we find that we can't disprove that from the evidence that we have," Kleine explained.

Scurlock's grieving father asked for further investigation: "I ask my people to stand by me strong but peacefully."
