Edward Molina, Nathan Sutherland's lawyer, the former nurse accused of raping and impregnating a disabled patient, said Tuesday that his client will fight a court-ordered HIV and STD test. Molina claimed that the tests would violate his client's constitutional rights - and said it would be easier for the victim to undergo tests.
Molina also argued that the 29-year-old was probably tested after giving birth to a baby boy on December 29th.
According to the authorities, Sutherland, who turns 37 next month, was working as a nurse at Hacienda Healthcare in Phoenix.
Employees stated that they had no idea of her pregnancy even after giving birth.
Investigators reported that Sutherland's DNA was a sample of the woman's newborn, taken care of by her family. He pleaded not guilty.
A complex case management hearing was scheduled for May 21.
