No charges against Colorado officer who fatally shot a 73-year-old homeowner

The Colorado police officer who fatally shot a homeowner holding a gun just after he killed an intruder inside his home will not face charges, according to prosecutors.

Officer Drew Limbaugh didn't know who was the victim, Gary Black, and fire when he refused police commands to drop his gun, according to Adams County District Attorney Dave Young who described the shooting as "harrowing tragedy."

Black, 73, had woken on July 30 night at around 1:30 a.m. after hearing his 11-year-old son screaming as an intruder was attacking him inside the bathroom. Black shot the intruder Dajon Harper, 26, twice in the chest. Police saw Black come into the hallway holding the gun, and refusing the orders to drop it, which likely was because of hearing impairment due to his military service.
