Judge to determine fate of new Mexico shooter who killed own family

The New Mexico man who killed his parents and three of his siblings is set to return to court Monday, the hearing will focus on whether he was been rehabilitated while in custody, and prepared to re-enter society.

Nehemiah Griego, 21, pleaded guilty three years ago to murder and child abuse charges after he shot his parents, two sisters and one brother dead in 2013 when he was 15.

The case had known hours of hearing and appeals over his mental health treatment and over whether he should be sentenced as a juvenile or an adult.

In New Mexico, the maximum sentence for a crime committed by someone considered a juvenile doesn't extend beyond the person's 21 st birthday which means Griego would be released if sentenced as a juvenile.
