Inmate held on ICE detainer was unintentionally released,Authorities cannot re-arrest him.

5years ago

An inmate who was being held on an Immigration and Customs Enforcement detainer was unintentionally released Tuesday.

Ricardo Mujica was walked out of the Bexar County Jail along with other inmates who were to be freed, around 7 a.m.

Mujica had been arrested on a state domestic violence charge, convicted and sentenced to four years of probation, but he was being held in the jail on the immigration detainer.

According to Sheriff Javier Salazar, Mujica had already satisfied the conditions of his state charge when he was released and therefore local officers have no authority to arrest him and he is not considered an escapee.

ICE officials did not issue a statement regarding the inmate's case because most public affairs officers are currently out of the office thanks to the government's shutdown.
