Phoenix immigration judge will reopen the case of deported, living in the country illegally.

Lawyer Ezequiel Hernandez learned Thursday that Judge Silvia Arrellano had granted a petition to reopen the immigration case of Jose Arturo Gonzalez Carranza, who was married to the Pfc army. Barbara Vieyra, killed in 2010 in Afghanistan, was living illegally in the country.

According to Hernandez, who represents Gonzalez Carranza, the ICE prosecutors did not oppose his request. ICE officials declined to comment.

Earlier this month, a judge ordered Gonzalez Carranza to be deported for failing to attend a hearing. Hernandez says Gonzalez Carranza was only aware of the hearing on April 8. He was deported to Mexico three days later.
